TikTok Buyer Policy (US)

By shopping on TikTok, you’re agreeing to this policy and our Terms of Service.

1. Eligibility

You must be 18 years and older to purchase products on TikTok. You may be required to provide certain onboarding information prior to making your first purchase on TikTok Shop. We will use such onboarding information to determine if you are eligible to make a purchase on TikTok Shop.

2. TikTok as a marketplace

TikTok is a marketplace that allows sellers (each a “Seller”) to promote and sell products on TikTok Shop. When you purchase a product on TikTok, you are purchasing that product directly from a Seller. TikTok is not a party to your transaction or agreement with Sellers. We do not represent, guarantee, or endorse any products, information, or services provided by Sellers to you.
We make no representations, warranties, or guarantees, whether express or implied, that any content on TikTok Shop is accurate, complete, or up to date. Where TikTok Shop contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no visibility or control over the contents on or available through those sites or resources and you acknowledge and agree that we have no liability for any such content. Such links should not be interpreted as approval by us of those linked websites or information you may obtain on or through them.

3. Sellers' shop policies

Product information including the purchase price for a product is provided by the relevant Seller on the Product Detail Page. We do not guarantee the accuracy of such product information. Subject to TikTok Shop’s policies and guidelines including the TikTok Shop Customer Order Cancellation, Return and Refund Guidelines, each Seller determines their own shop policies including those for cancellations, returns, and refunds. The delivery time will vary depending on the delivery options offered by the Seller, as set out on the Product Detail Page. The logistics for arranging a return of a product and any associated fees will be as you agree with the Seller. You should review the information of the products which you intend to purchase before placing an order on TikTok Shop.
Sellers are responsible for making sure that any product they sell is fit for purpose and corresponds with the description it provides on the Product Detail Page and they are responsible for complying with any refund, replacement or cancellation requests pursuant to their shop policies.

4. Purchases on TikTok Shop

You understand that when you purchase a product from a Seller on TikTok Shop, such Seller may appoint an agent (including without limitation a third-party payment service provider) for the sole purpose of collecting amounts due to such Seller. You agree that receipt of funds by such agent (including without limitation a third-party payment service provider) will be considered receipt of those funds by the Seller.
Please note that when you purchase an item in the US, sales taxes and other taxes and government fees (collectively, the “Taxes and Fees”) might be applicable to your purchase, irrespective of the seller’s location. Generally, whether the Taxes and Fees apply to your purchases will vary depending on a variety of considerations including, but not limited to, the nature of the item and the ultimate shipping address of your order.
TikTok is deemed to be a marketplace facilitator for sales facilitated through TikTok Shop in most U.S. jurisdictions. If you are based in such a jurisdiction, TikTok will be legally required to calculate, charge, and collect the Taxes and Fees on sales made through TikTok Shop. Prices advertised on the platform are exclusive of any applicable Taxes and Fees, which will be calculated and charged at checkout.
You understand and agree that, where applicable, you will act as the importer of record of the products purchased by you on TikTok Shop and imported into the United States. You further agree that you shall, in relation to such importation, comply with all applicable laws and regulations of the United States. You hereby authorize TikTok or the Seller, as applicable, to appoint a -third-party agent to handle customs clearance and pay all applicable customs duties, taxes, or fees on your behalf. You also understand and agree that you will be solely responsible for any charges, fines, or similar costs incurred or issued in connection with the importation of such products into the United States.

5. Seller eGift Cards

When purchasing closed-loop electronic gift cards issued and/or sold by third parties (each, a "Seller eGift Card") on TikTok Shop, you understand that:

• A Seller eGift Card is issued and sold by the third-party Seller and/or issuer identified on the relevant Product Detail Page, and that TikTok merely acts as an agent for the sole purpose of collecting amounts due to such Seller and performs certain related ministerial functions;
• TikTok relies on licensed third-party payment service providers to collect amounts due to Sellers;
• Once you make the purchase of the closed-loop gift card issued and/or sold by the third-party merchant, the card is valid and redeemable and not voidable thereafter, unless permitted under applicable gift card laws or otherwise in accordance with the Seller and/or issuer's gift card terms;
• Seller eGift Cards can be redeemed only on the third-party Seller and/or issuer's websites for goods and services offered by the Seller and/or issuer;
• Seller eGift Card value cannot be redeemed on TikTok or linked to any TikTok account or TikTok Shop Balance;
• Seller eGift Cards sold remain non-refundable and cannot be converted back into cash or other value by TikTok; and
• Your purchase and use of a Seller eGift Card may be subject to additional terms and conditions set forth by the relevant Seller and/or issuer, and TikTok is not a party to such terms.

6. Digital Products

When purchasing certain video games, in-game items or characters, In-Game Tokens (as defined below), software, eBooks, and other related products (each, a "Digital Product") from Sellers on TikTok Shop, you understand that:

• Digital Products are redeemable only from the Seller or publisher identified on the relevant Product Detail Page though a license key, unique code, or other similar access method that will be sent to the recipient e-mail address you provide in connection with placing your order, and cannot be downloaded or redeemed directly from TikTok;
• Your use of a Digital Product may be subject to additional terms and conditions (such as an end-user license agreement) set forth by the relevant Seller or publisher, and TikTok is not a party to such terms;
• You may need to have or create an account with the relevant Seller or publisher in order to redeem and use such Digital Product; and
• Digital Products may be hosted on servers maintained by the relevant Seller or publisher for use over the internet, and TikTok cannot guarantee that such Digital Products will remain available to you.

When purchasing tokens redeemable for digital items or other services in connection with a video game or similar third-party application (each, "In-Game Tokens") on TikTok Shop, you understand that such In-Game Tokens are issued and sold by the Seller or publisher identified on the relevant Product Detail Page, and that TikTok merely acts as an agent in these transactions for the sole purpose of collecting amounts due to such Seller or publisher and performs certain related ministerial functions. TikTok relies on licensed third-party payment service providers to collect such amounts. Once a Seller's or publisher's In-Game Tokens are issued, they are valid and redeemable at the time of purchase and are not voidable thereafter unless permitted under applicable laws, or otherwise in accordance with the Seller or publisher's In-Game Tokens terms and conditions. In-Game Tokens may be made available to you by the relevant Seller or publisher directly in the video game or similar third-party application. They are non-refundable and cannot be redeemed, exchanged, resold, cashed out, or stored on or through TikTok Shop or the TikTok app.

7. Creating content and reviews

As a TikTok user you have the opportunity to create videos, comments, and other content about products you browse, use, or purchase on TikTok, including by posting reviews about products you have purchased.
By posting a review or otherwise creating content on TikTok about products on TikTok Shop, you agree that you:

• own or otherwise control all of the rights in the content (including the content of your reviews);
• understand, as stated in TikTok’s Terms of Service, that TikTok has a license to use any content you provide to TikTok (including the content of your reviews);
• will only post content and reviews that are accurate and that reflect your genuinely held views about a product;
• will not post anything false, inaccurate, misleading, deceptive, offensive, illegal, or defamatory (including as part of a review of a product);
• will only post reviews of products you have purchased from Sellers on TikTok Shop;
• will not post or solicit shill reviews, trade reviews, or otherwise do anything to undermine the integrity of reviews on TikTok;
• will not violate the TikTok Shop Prohibited Products Guidelines.

We reserve the right to remove your content, including videos, comments, and reviews, that violate our policies or Terms of Service.

8. Cancellations and Returns

Your purchases on TikTok Shop are subject to TikTok Shop's and Sellers' cancellation and return policies. It is your responsibility to review such policies in our Buyer Help Center and the product detail pages of the products you are purchasing.
You understand that inaccuracies or errors with respect to pricing, availability, or other product information might occur from time to time. You agree that in the event of such inaccuracies or errors relating to your order, TikTok or Sellers may reject or cancel your order with no further obligations to you, except that you will receive a full refund if you have already paid for the cancelled order.
TikTok may also cancel any orders or block any return requests from you if TikTok, in its sole discretion, determines or suspects that such orders or return requests are fraudulent.

9. Reporting a Problem

If you have a complaint relating to a product, you should contact the Seller directly. You may also reach out to our customer service team at service-us@tiktok.com. TikTok may facilitate communications between you and the Seller, but we have no obligation to do so and TikTok is not a party to any dispute between you and Sellers.

10. Suspension and Termination

If we know or reasonably suspect that you are in material or persistent breach of this TikTok Buyer Policy or are engaged in fraud, we may temporarily or permanently suspend or terminate your buyer account or impose limits on or restrict your access to TikTok Shop, or other parts or all of the TikTok services, in accordance with the TikTok Terms of Service.

• Information About You and Your Privacy

Please note that Sellers are independent controllers of the data that they collect about you via TikTok Shop, and TikTok is not responsible for their compliance with applicable law.
