What are Counterfeit Products?
Counterfeiting usually refers to the illegal manufacture, distribution, and sale of branded replicas of a product, which may include but is not limited to, the unauthorized use of a trademark that is identical or very similar to another’s registered trademark on goods covered by the registration, or on a product's packaging or marketing materials. The listing, marketing, and sale of counterfeit products are strictly prohibited on TikTok Shop. This includes the display of brand names, logos, or trademarks on products or in product images or descriptions, including on livestreams or videos, without authorization from the brand owner.Examples of Counterfeit Products
Counterfeit products include fake goods, or unauthorized copies or replicas.Why Counterfeit Products are Prohibited
TikTok Shop strives to protect the rights of owners from intellectual property infringement. As such, TikTok Shop does not tolerate counterfeit products. Advertising and selling counterfeit products on TikTok Shop is strictly prohibited. We require all products offered for sale on TikTok Shop to be safe and authentic.Prohibited Behavior
When advertising on TikTok Shop, creators, and sellers must avoid prohibited behaviors, including but not limited to:- Displaying any unauthorized brand names, trademarks, or logos in any form of content, such as the product details page, videos, and livestreams.
- Intentionally blurring or hiding brand names or logos.
- Behaviors and/or written or verbal messages that imply the sale of counterfeit products.
Seller Responsibilities
It is the seller's responsibility to source, sell, and fulfill only authentic products. Any sale of illegal and counterfeit products is strictly prohibited. The seller must only sell products with prior authorization from the brand owner.Sellers must maintain relevant and credible documentation that certifies the authenticity of the advertised products. In the event of a suspected counterfeit, these documents will be requested to facilitate TikTok Shop's investigations.
Sellers are responsible for ensuring that all products sold on TikTok Shop comply at all times with the applicable laws and regulations of wherever their products are sold. Sellers must review our Intellectual Property Policy and the local laws and regulations on a regular basis.
Creator Responsibilities
As a creator, you can not create, post, upload, stream, or share:- Any content related to or featuring goods that are not compliant with the laws of the destination market, such as counterfeit products.
- Any content related to or featuring goods that are misleading, incomplete, or discriminatory towards consumers.
Promoting Counterfeit
TikTok Shop takes counterfeit products very seriously and will take enforcement actions against sellers and creators who violate our policies, including but not limited to termination from the TikTok Shop. The enforcement actions taken against a seller or creator depend on the severity and frequency of violations.
