TikTok Buyer Policy

TikTok Shop is a marketplace that allows you to browse for and purchase products directly from merchants across the globe.
This policy is a part of our Terms of Service. By shopping on TikTok, you’re agreeing to this policy and our Terms of Service.

1. Eligibility

You must be 18 years and older to purchase products on TikTok. You may be required to provide certain onboarding information prior to making your first purchase on TikTok Shop. We will use such onboarding information to determine if you are eligible to make a purchase on TikTok Shop.

2. TikTok as a marketplace

TikTok is a marketplace that allows sellers (each a “Seller”) to promote and sell products on TikTok Shop. When you purchase a product on TikTok, you are purchasing that product directly from a Seller. TikTok is not a party to your transaction or agreement with Sellers. We do not represent, guarantee, or endorse any products, information, or services provided by Sellers to you. We make no representations, warranties, or guarantees, whether express or implied, that any content on TikTok Shop is accurate, complete, or up to date. Where TikTok Shop contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no visibility or control over the contents on or available through those sites or resources and you acknowledge and agree that we have no liability for any such content. Such links should not be interpreted as approval by us of those linked websites or information you may obtain on or through them.

3. Sellers' shop policies

Product information including the purchase price for a product is provided by the relevant Seller on the Product Detail Page. Subject to TikTok Shop’s policies and guidelines, each Seller determines their own shop policies including those for cancellations, returns, and refunds. The delivery time will vary depending on the delivery options offered by the Seller, as set out on the Product Detail Page. The logistics for arranging a return of a product and any associated fees will be as you agree with the Seller. You should review the information of the products which you intend to purchase before placing an order on TikTok Shop. Sellers are responsible for making sure that any product they sell is fit for purpose and corresponds with the description it provides on the Product Detail Page and they are responsible for complying with any refund, replacement or cancellation requests pursuant to their shop policies.

4. Purchases on TikTok Shop

You understand that when you purchase a product from a Seller on TikTok Shop, such Seller may appoint an agent (including without limitation a third-party payment service provider) for the sole purpose of collecting amounts due to such Seller. You agree that receipt of funds by such agent (including without limitation a third-party payment service provider) will be considered receipt of those funds by the Seller. Please note that when you purchase an item in the US, sales taxes may be applicable to your purchase, irrespective of the seller’s location. Generally, whether sales taxes apply to your purchases will vary depending on a variety of considerations including, but not limited to, the nature of the item and the ultimate shipping address of your order. TikTok is deemed to be a marketplace facilitator for sales facilitated through TikTok Shop in most U.S. jurisdictions. If you are based in such a jurisdiction, TikTok will be legally required to calculate, charge, and collect sales taxes on sales made through TikTok Shop. Prices advertised on the platform are exclusive of applicable sales taxes, which will be calculated and charged at checkout.You understand that all products purchased by you on TikTok Shop are shipped and delivered to you pursuant to a shipping contract. You agree that as a result, risk of loss and title for the products purchased by you on TikTok Shop will pass to you upon delivery of such Products to the carrier. You understand and agree that, where applicable, you will act as the importer of record of the products purchased by you on TikTok Shop. You hereby authorize TikTok to appoint an agent (including without limitation a third-party logistics service provider engaged by TikTok) to pay all applicable customs duties on your behalf.

5. Creating content and reviews

As a TikTok user you have the opportunity to create videos, comments, and other content about products you browse, use, or purchase on TikTok, including by posting reviews about products you have purchased. By posting a review or otherwise creating content on TikTok about products on TikTok Shop, you agree that you:

• own or otherwise control all of the rights in the content (including the content of your reviews);
• understand, as stated in TikTok’s Terms of Service, that TikTok has a license to use any content you provide to TikTok (including the content of your reviews);
• will only post content and reviews that are accurate and that reflect your genuinely held views about a product;
• will not post anything false, inaccurate, misleading, deceptive, offensive, illegal, or defamatory (including as part of a review of a product);
• will only post reviews of products you have purchased from Sellers on TikTok Shop;
• will not post or solicit shill reviews, trade reviews, or otherwise do anything to undermine the integrity of reviews on TikTok;
• will not violate the TikTok Shop Prohibited Products Guidelines.

We reserve the right to remove your content, including videos, comments, and reviews, that violate our policies or Terms of Service.

6. Cancellations and Returns

Subject to TikTok Shop’s policies and guidelines, each Merchant has his or her own cancellation and return policies, which should be outlined in their shop policies. It is your responsibility to review a Merchant’s policies relating to cancellations and returns. 7. Reporting a Problem

If you have a complaint relating to a product, you should contact the Merchant directly. You may also reach out to our customer service team at service-us@tiktok.com. TikTok may facilitate communications between you and Sellers but we have no obligation to do so and TikTok is not a party to any dispute between you and Sellers.

8. Suspension and Termination

If we know or reasonably suspect that you are in material or persistent breach of this TikTok Buyer Policy, we may temporarily or permanently suspend or terminate your buyer account or impose limits on or restrict your access to TikTok Shop, or other parts or all of the TikTok services, in accordance with the TikTok Terms of Service.

Please note that Sellers are independent controllers of the data that they collect about you via TikTok Shop, and TikTok is not responsible for their compliance with applicable law.
