TikTok offers creators ("you") this AI "lip-sync dubbing" tool through which you can record a short video of yourself talking, a script you'd like to use for your shoppable video, and a desired language, and the tool will generate a video of you appearing to speak the script in the selected language ("[Dubbed Videos]"). Once generated, you can view these Dubbed Videos by going to [page name/path][, and you can delete uploaded videos used in connection with generating Dubbed Videos by going to [page name/path]. The TikTok entity offering this AI lip-sync dubbing feature is the TikTok entity that provides you with the TikTok platform as set out in the TikTok Terms of Service ("we" / "TikTok"). Your use of this AI lip-sync dubbing feature is subject to the following terms and conditions ("Terms"):1. By using this feature:a. You acknowledge that your uploaded video (and associated personal data) may be processed by TikTok as described in the TikTok Shop Creator Privacy Policy;b. You affirm, represent and warrant that you are the only person featured in the video/audio you provide, that you are age 18 or older, and that you are not a resident of or physically located in Illinois or Texas; andc. Your use of this feature and our processing under these Terms do not violate any third party rights (including, without limitation, intellectual property, privacy, and publicity rights).2. You acknowledge that [Dubbed Videos] use automated systems that may produce inaccurate, incomplete, or unintended outputs. You are and will remain solely responsible for reviewing all generated [Dubbed Videos] to ensure that they are accurate, complete, and in compliance with applicable laws, the TikTok Shop Creator Terms of Use, and other platform policies including, without limitation, the TikTok Community Guidelines and the TikTok Shop Content Policy.3. You give TikTok permission and consent to host, process, modify, and reproduce your uploaded content for the purpose of (a) providing you with the [AI Dubbing] feature, (b) delivering the [Dubbed Videos] to you, and (c) further training our [AI Dubbing] feature or any other of TikTok's AI systems. This permission is not exclusive, and TikTok may share it with others as needed to help deliver the [AI Dubbing] feature.4. You retain ownership of your uploaded content, and nothing in these Terms assigns or waives personality, image or performer moral rights beyond what is permitted by the applicable law.5. You agree to not use this feature, the [Dubbed Videos], or any derivative thereof:a. In any way that violates any applicable national, federal, state, local or international law or regulation;B. For the purpose of exploiting, harming or attempting to exploit or harm minors in any way;c. To generate or disseminate verifiably false information with the purpose of harming others;d. To generate or disseminate personal identifiable information that can be used to harm an individual;e. To generate or disseminate information or content, in any context (e.g. posts, articles, tweets, chatbots or other kinds of automated bots) without expressly and intelligibly disclaiming that the text is machine generated;f. To defame, disparage or otherwise harass others;g. To impersonate or attempt to impersonate others;h. For fully automated decision making that adversely impacts an individual’s legal rights or otherwise creates or modifies a binding, enforceable obligation;i. For any use intended to or which has the effect of discriminating against or harming individuals or groups based on online or offline social behavior or known or predicted personal or personality characteristics;j. To exploit any of the vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;k. For any use intended to or which has the effect of discriminating against individuals or groups based on legally protected characteristics or categories;l. To provide medical advice and medical results interpretation;m. To generate or disseminate information for the purpose to be used for administration of justice, law enforcement, immigration or asylum processes, such as predicting an individual will commit fraud/crime commitment (e.g. by text profiling, drawing causal relationships between assertions made in documents, indiscriminate and arbitrarily-targeted use).6. TikTok is not responsible for any sharing or dissemination of Dubbed Videos generated through this feature that occurs outside the feature itself.7. TikTok may apply visible or audible indicators (e.g., "[AI-generated]") to, and embed machine-readable markers in the file metadata of, [Dubbed Videos], in line with the applicable law.8. These Terms shall be subject to the "Dispute Resolution" section of the TikTok Terms of Service.9. If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms, and the remaining provisions of the Terms will continue to be valid and enforceable.10. These Terms apply in addition to the TikTok Terms of Service, the TikTok Shop Creator Terms of Use, and any other terms and policies which may apply to your use of the TikTok app from time to time.
